DMCA Takedown Policy
Overview
AudioBook Genesis respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We have registered a Designated Agent with the United States Copyright Office (Registration Number DMCA-1073771) to receive copyright infringement notices.
In accordance with 17 U.S.C. § 512(c), if you believe that material available on AudioBook Genesis infringes your copyright, you may submit a takedown notice to our Designated Agent. We will process valid notices within 24 hours and take appropriate action.
How to Submit a Takedown Notice
To be valid under 17 U.S.C. § 512(c)(3), your written notice must include all of the following:
- 1 Signature of the copyright owner or authorized agent. A physical or electronic signature of the person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- 2 Identification of the copyrighted work. A description of the copyrighted work (or a representative list if multiple works are covered by a single notification).
- 3 Identification of the infringing material and its location. A description of the material claimed to be infringing and information reasonably sufficient to permit us to locate it on the service (e.g., a URL).
- 4 Your contact information. Your name, address, telephone number, and email address so that we may contact you.
- 5 Good faith statement. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- 6 Statement of accuracy under penalty of perjury. A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Incomplete notices may not receive a response. Knowingly submitting a false notice may result in liability under 17 U.S.C. § 512(f).
Where to Send Your Notice
Send your DMCA takedown notice by email to our Designated Agent:
We process valid DMCA notices within 24 hours of receipt. Upon verification, we will promptly remove or disable access to the infringing material, notify the user who uploaded the content, and log the action for our records.
Counter-Notification Procedure
If you believe your material was removed as a result of mistake or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g)(3). Your counter-notice must include:
Send your counter-notice to the same address: dmca@audiobookgenesis.com. Upon receipt of a valid counter-notice we will forward it to the original complainant and may restore the removed material after 10–14 business days unless the complainant files a court action.
Repeat Infringer Policy
In accordance with the DMCA and other applicable law, AudioBook Genesis maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.
